    MP investiga prática de racismo e injúria de alunas contra professora de faculdade em Itaituba

    O Ministério Público do Estado do Pará (MPPA) instaurou Procedimento Investigatório Criminal para apurar prática de racismo e injúria qualificada feita uma rede social contra uma professora da Faculdade de Itaituba (FAI), no sudoeste do Pará. O alvo do MP são alunas do 9º semestre do curso de fisioterapia da instituição. A vítima é a professora Isabelle Costa. A instauração do procedimento foi informada pelo MP nesta quarta-feira (11), por meio de portaria publicada no Diário Oficial do Estado (DOE). 

    À frente do procedimento investigatório criminal está o promotor de Justiça, Ítalo Costa Dias, que vai investigar as condutas delituosas tipificadas como injúria racial e racismo institucional, praticadas pelas acadêmicas da FAI. Este fato ocorreu no mês de abril deste ano e teve ampla repercussão no município.

    A professora Isabelle Costa, após os ataques nas redes sociais, pediu desligamento da faculdade. O diretor da instituição, no dia 18 de abril, Abel Huyapuan de Sá Almeida, divulgou uma nota informando que a FAI criou uma comissão de processo administrativo disciplinar para também apurar ‘a falta disciplinar por suposta prática de injúria racial, garantindo a ampla defesa e contraditório aos envolvidos’. 

    Mensagens com teor racistas foram vazadas de conversas em grupo de Whatsapp da turma direcionadas à professora Isabelle Costa. “(…) nossa querida fuá”, “safada”. “Ela não lava os cabelos”. Essas foram algumas das mensagens compartilhadas em grupos de redes sociais. 

    O caso está sendo investigado pela 1ª Promotoria de Justiça de Itaituba. 

    De acordo com o Código Penal Brasileiro, o crime de injúria racial está previsto no parágrafo 3º do  artigo 140, do Código Penal. Trata-se de uma forma de injúria qualificada, na qual a pena é maior, e não se confunde com o crime de racismo, previsto na Lei 7716/2012.

    Para a caracterização da injúria racial é necessário que haja ofensa à dignidade de alguém, com base em elementos referentes à sua raça, cor, etnia, religião, idade ou deficiência. 

    A a pena aumenta para 1 a 3 anos de reclusão.
